These Terms govern your use of Hardcore Worldwide (the "Service"), operated by [OPERATOR NAME] ("we"). By creating an account or using the Service you agree to them, to the Community Guidelines and to the Privacy Policy.
1. Who can use it. You must be 13 or older. Direct messages, Floor hosting and requests, Van listings, Gear sales, Confessions and paid services require that you are 18 or older. You are responsible for your account and for keeping the email address and phone number on it under your control; login codes sent there are as good as a password.
2. What the Service is. The Service is a platform. We host what members post and we connect people. We are not a party to any transaction or arrangement between members or with third parties: Floor stays, van rentals, gear sales, booking deals, ticket sales, merch orders or ad buys. Organizers, bands and sellers are the merchants of record for what they sell; we may collect fees for the use of the platform.
3. As is. The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement and uninterrupted operation.
4. Limitation of liability. To the extent permitted by law, [OPERATOR NAME] and its people are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim is capped at the greater of $100 or the fees you paid us in the twelve months before the claim.
5. Assumption of risk. In-person meetups, stays at a stranger's home, vehicle rentals, shows and travel carry risk. You take part at your own risk and you agree to use judgment, verify people and arrangements, and follow local law.
6. Indemnification. You will defend and hold harmless [OPERATOR NAME] from claims arising out of your content, your conduct, your transactions with other members or third parties, or your violation of these Terms.
7. Your content. You own what you post. You grant us a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce and distribute it on the Service, in the weekly email and in promotion of the Service on social media. The license ends when you delete the content, except for cached copies, backups kept for a limited time, and content other members have quoted. You represent that you have the rights to everything you upload, including music, samples, photos, zines and designs.
8. Prohibited conduct. No harassment, threats or doxxing. No sexual content or nudity anywhere on the Service. No hate. No scams, spam or pay-to-apply schemes. No scraping or automated bulk access. No impersonation. No illegal goods, counterfeits or bootlegs in Merch or Gear For Sale. No naming or identifying private individuals in Confessions, tips or drama threads. Public figures may be discussed on the Board with sources.
9. Moderation. We may remove any content, suspend or terminate any account, and decline any transaction at our discretion, with or without notice. We have no obligation to monitor but we do run automated checks on text and images, including direct messages, for prohibited content.
10. Third-party services. The Service links to and embeds Amazon, Spotify, YouTube, Instagram, Stripe, Printful, eBay, Discogs, Discord and others. Their terms and privacy policies govern your use of them. Some links are affiliate links: as an Amazon Associate, Hardcore Worldwide earns from qualifying purchases.
11. Paid services. Ad orders, sponsorships, van listing fees, work listings and subscriptions are billed through Stripe. Fees for completed ad runs, published listings and elapsed subscription periods are not refundable. Rejected creative is refunded. A chargeback on a legitimate charge results in suspension.
12. Copyright. We respond to notices under the DMCA; see the Copyright Policy. Repeat infringers (three strikes) are terminated.
13. Dispute resolution. Any dispute with [OPERATOR NAME] will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small claims court. You and we waive the right to a jury trial and to participate in a class action. You may opt out of arbitration within 30 days of first accepting these Terms by emailing us (see /legal/arbitration-opt-out). These Terms are governed by the laws of [STATE], without regard to conflict of law rules.
14. Severability and changes. If any part of these Terms is unenforceable, the rest stands. We may change these Terms; material changes get 14 days' notice by email and a prompt to accept at your next login.
15. Contact. [OPERATOR NAME], [CONTACT ADDRESS]. See /contact.
